City Sued for Improper Management

The owners of Apple Village Mobile Home Estates are suing the city of Edmond, Oklahoma, for failing to properly maintain the stormwater system. The claims against the city are for nuisance, negligence, trespass and unjust enrichment, relating to stormwater plans approved by the city.

The city approved plans for private stormwater facilities, which increased and redirected the flow of stormwater through a system that crosses the mobile home park. “Every time it rains, and it has been a lot lately, it floods on the north side,” said the owner’s attorney. The flooding has resulted in increased erosion, and structural damage, collapsing a fence and breaking one of the concrete walls of the drainage system. According to the owner’s attorney, a cleanup of the drainage system was quoted at $25,000.
